The Protection Visa (subclass 866) is for people who are in Australia and engage Australia’s protection obligations. This visa allows you to live and work in Australia as a permanent resident.
Who Can Apply?
You may be eligible for a Protection Visa if you:
- Are in Australia (lawfully or unlawfully)
- Owe protection obligations to Australia
- Meet health, security, and character requirements
- Have not held certain visas previously
What Does Protection Mean?
Australia owes you protection if you are a refugee or meet the complementary protection criteria:
Refugee Criteria: You have a well-founded fear of persecution in your home country due to race, religion, nationality, membership of a particular social group, or political opinion.
Complementary Protection: There is a real risk you will suffer significant harm if returned to your home country.
Application Process
The process involves a Protection Visa Application, followed by an interview with a departmental officer. The department will assess your claims and make a decision.
